PET
CONTRACT
The puppy/dog is
guaranteed healthy at the time of purchase.
The purchaser has 48 hours (excluding Sundays) from the time of
purchase to have the puppy/dog examined by his/her veterinarian as to
soundness of health. If the veterinarian finds any major health problems, the
cause, which is clearly attributable to the breeder, the purchaser may
bring the puppy/dog back to the breeder, with a letter from the
veterinarian explaining the problem he/she found.
The breeder must be contacted within the 48 hour period after purchase
as to any problems, and the puppy/dog must be returned within 72 hours
of purchase, at this time the breeder will, upon receipt of the
puppy/dog and all items given with the puppy/dog (including the ADBA
papers to be signed back to the breeder) refund the purchaser the full
purchased price of the puppy/dog, by check or cash.
Any veterinarian’s diagnosis shall be subject to confirmation by a
veterinarian chosen by the breeder. Should said veterinarian not agree with the diagnosis, the
matter should be presented to a third party veterinarian mutually agreed
upon by the breeder and the purchaser.
The purchaser of the
above-described dog further agrees to the following conditions.
1.
Feed the puppy/dog according to the directions provided by the
seller or licensed veterinarian.
2.
Provide for the welfare of the puppy/dog by yearly health checks,
a parasite prevention program, yearly vaccinations as recommended by his
veterinarian, and heartworm prevention where applicable.
3.
Provide a clean, safe environment where the puppy/dog will not be
subject to teasing or abuse.
4.
The dog will not be allowed to run at large or be chained at any
time.
5.
In no case will the seller be held liable for any damage or
injury caused by this puppy/dog.
6.
In the even that the terms of this agreement are not complied
with the seller is entitled to $5,000 in damages and the return of the
puppy/dog plus any legal fees and costs associated with the enforcement
of this agreement.
7.
Purchaser has 72 hours to sign and return contract or the terms
of this contract automatically become enforced.
The breeder reserves the
right to inquire and inspect the way the puppy/dog is kept.
If the puppy/dog is mistreated (allowed to run loose, left in
unsanitary conditions, unhealthy, etc.) the breeder has the right to
take the puppy/dog from the owners with no compensation to the owner.
The owner will be required to sign the papers over to the
breeder.
The breeder is to be
notified if the owner moves, or if the owner cannot keep the puppy/dog
for any reason. The breeder has first option to take the puppy/dog back from
the owner. If the breeder
does not want the puppy/dog the breeder is to be notified as to the new
owner’s name, address, and phone #.
The owner is to have the new owner sign this agreement and mail a
copy back to the breeder.
The breeder is not
responsible for any veterinarian bills the owner may incur after the
purchase of the puppy/dog.
I, the purchaser, have
read and understand the terms of this guarantee/agreement.
I also understand that if I do not uphold my part of this
agreement, the breeder has the right to take the puppy/dog at no
compensation to the purchaser.
